Processing of All Chapters of Bankruptcy - Chapter 7

You can discharge all your unsecured debts such as medical bills, credit cards, lawsuits, charge cards, etc., and start with a clean slate. Your house, cars, personal belongings, checking accounts, saving accounts, car loans, leases, and any retirement or pension plan are not affected by the Chapter 7 Petition in any way, shape, or form.

Most personal items are exempted by federal law.

The case is simple to file. We process the paperwork for you, and you sign the documents. You have the choice to have or not to have an attorney present in court.

From the day that we file the petition in court, we will have an automatic stay case number. This case number represents a federal restraining order against any lawsuits, garnishments, levies, repossessions, foreclosures, collections, phone calls, letters, and any collection efferts by any attorneys, creditors, or collection agencies.

Tax Matters - Offers and Compromise

We are licensed by the IRS to inform you of all the options that you have in regard to offer and compromise and other payback options.

Most tax matters can be resolved through forms and working with the tax agent or representative of the IRS.

Any time you have a problem with your taxes or a dispute, the most important thing to remember is to file your taxes on time or as soon as possible. We don't know anyone who can help you if you don't file your taxes.

Depending on how old you are and what tupe of tax you have, you may have different options even in bankruptcy. If you own an amount that will not go away because of interest and penalties, you can reorganize the payment and stop the penalties through a Chapter 13 bankruptcy petition for up to five years and/or discharge interest and penalties from the past.

If you have a dispute with your taxes, your accountant or tax preparer is usually capable of determining if a mistake was made or if you just own the tax. If a mistake was made, you can amend the taxes to eliminate the owed portion.

If you own, you can arrange for a payment plan with the IRS.

Collection Problems

Learn all you need to know about collection practices. We will help you understand what you can do to stop collection agencies from calling. We will help you determine what you should be planning to do about your situation.

Each creditor or collection agency will have a different type of criteria regarding their collection practices. Solutions will also depend upon what stage of collection you are in.

Some creditors, after relentless collections, will charge off the debt as uncollectible in your credit report, and they will stop collecting for a while. This does not mean that you do not owe the debt. It is just pending upon collection.

Lawsuits

Repossessions

Repossessions of vehicles are the most common of legal repossessions of personal property. Usually when the debtor fails to pay on time according to the contractual agreement, the lender then makes a decision to protect himself. It is impossible to tell when a lender may decide to repossess a vehicle.

Every lender will have a different set of criteria depending on such factors as how behind in arrears the loan is and whether or not the insurance policy is current. Also the value of the vehicle and when it was purchased are important factors in determining whether or not it's worth repossessing the vehicle right away or not.

Some lease and contract agreements have a clause that, in the event of a repossession, the lender will force the debtor to repurchase the entire contract if the debtor wants their car back. That means that after the car is repossessed, even if your pay the late payments and the repossession fees, the lender may choose to still keep the car unless you come up with the entire amount of the loan.

Different lenders have different collection practices. You have to be careful because the lender will not tell you when he is about to repossess the vehicle. If he did, it would give you time to hide it.

Sometimes you are able to work out a payment arrangement with your lender if you are not too far behind. In an extreme case, when you have paid a lot of money into a car loan and you have a lot of equity in the car and you don't want to lose it, you may have the option to file a Chapter 13 bankruptcy reorganization plan to save the car and reorganize the loan into a three-year payback arrangement with the court.

If you are considering returning the car, you may consider the consequences of the deficiency that will be created after the car is sold and the lender has deducted the amount received for the car from the total amount of the loan including interest. Any money left over you will owe.

Foreclosures of Real Property

This subject deserves a lot of patience and time to make the right decision. Since so much is at stake when a home is in jeopardy, you should take the time to learn and plan the best option for your situation.

You have to be very careful when you are making decisions based on your home. Many factors need to be explored before you can receive the proper advice. If your goal is to keep the home that is facing a foreclosure proceeding, we can explain to you your different options based on your situation.

Your lender may have some options available for you. If you have no more options with the lender and you need to stop the sale of your home immediately, we can file a Chapter 13 bankruptcy and stop the foreclosure immediately.

In a Chapter 13 bankruptcy, the federal court will allow you to pay what you owe to your house in a three-year plan. Many other options apply to a Chapter 13 case, including your other bills and unsecured credit that will be included in the plan to stop the interest, reduce the payment, and help you get out of debt.
